TERMS & CONDITIONS

 

The person and/or company referring to this document that has hired the services of PhotoArt shall be referred to as ‘The Client’ or ‘The Company’.



1) Copyright

PhotoArt gives the copyright on all photographs supplied to the client for their own personal use. PhotoArt may use the images for internal promotions and for portfolio material on a website unless otherwise requested by The Client.


2) Reproduction

Reproduction of material for anything other than personal use must be granted by PhotoArt prior to transmission to any 3rd party source and a fee may need to be agreed. In the event that material is used without prior permission, PhotoArt reserve the right to charge a penalty for such use as well as the reproduction fees.


3) Likeness to person/colour/monitor

In accordance with the accepted practices of all professional photographers and photographic laboratories, the return of any technically acceptable photographs or prints or demands for refund or refusal to settle charges cannot be entertained on principle. No exception can be made to this rule, as we cannot be held responsible for individual tastes or expectations.


4) Failure

Whilst every care is taken at every stage of the photographic process, in the event of a camera failure, operator error, data failure, or any other unforeseen event, PhotoArt can accept no responsibility for any losses however incurred as a result of any such failure beyond a full refund of the original purchase price.


5) Permanence

All photographs supplied by PhotoArt are produced to a high standard using high tech equipment and processes. However, all colour photographs will, in time, fade, especially in the conditions of direct sunlight or behind glass. PhotoArt cannot accept any responsibility for this gradual image deterioration.


6) Weather Conditions

PhotoArt can take no responsibility for weather conditions if the job is to be completed outside. The agreed price for work commissioned must be paid for in full. PhotoArt suggests to The Client that they take out Insurance.


7) Research of past work

All work undertaken is archived after 12 months. Therefore PhotoArt reserve the right to charge for a search fee to retrieve data after the 12-month period.


8) Prices

All wedding packages are agreed at the time of booking. Wedding albums may increase in price if the album is not ordered within 12 months from the date of the wedding. All other photo shoots the prices remain valid for 30 days. PhotoArt is not registered for VAT.


9) Payment Terms

All invoices should be paid in full within 7 days of the commission. Late payments may result in PhotoArt adding interest. Deposits are taken on request.


10) Photographer Availability

PhotoArt will ensure that the photographer you have selected will attend the photo shoot, however in the event of illness it may become necessary to substitute the photographer. We will ensure the substitute photographer will be of the same standard as the one you have booked.


11) Cancellation

We regret we are unable to refund deposits for wedding bookings after 3 weeks of the actual booking. With regard to other photographic bookings, in the event that a booking is cancelled within 60 days of the event, PhotoArt will return all monies less a 10% handling charge. If cancelled after that time, PhotoArt reserve the right to retain 50% of the total amount in retrospect of any work that could have been booked for that date. If a deposit has not been taken, PhotoArt may in accordance with these terms raise an invoice for a cancellation fee. PhotoArt recommends that The Client take out the relevant insurance.


12) Image Manipulation

By sending imagery to PhotoArt for the purpose of manipulation, retouching or any other form of digital adjustment; The Client is granting PhotoArt permission to reproduce the image only for the purposes of The Client.


13) Signed Proofs/Album requests

In the event that PhotoArt is requested to produce any work under Item 12 or any other un-editable materials, the Client will receive a digital proof page to be signed. This proof page is a legally binding document in its own right and as such, PhotoArt will not accept any responsibility for mistakes not detected by The Client at that stage.


14) Orders

Orders can be received verbally or in writing. Orders taken verbally will be followed up in writing from PhotoArt to The Client as confirmation. PhotoArt will take no responsibility for mistakes made that have not been notified of by The Client after this stage.
